Scram of California, Inc. Class Action Lawsuit in San Diego Superior Court

Today a Class Action lawsuit was filed against Scram of California, Inc., and its sister company Alcohol Monitoring Systems, Inc.

The purpose of this lawsuit is based on product liability and the corrupt devices that they manufacture. In the lawsuit, Anthony Oliver v. Alcohol Monitoring Systems, Inc., the Plaintiff, 35 year old Anthony Oliver has filed the lawsuit alleging that, among other things, the companies are profiting grossly, while innocent people are thrown in jail. These companies are profiting in the millions each year.

    3. Ive had it on cor about 6 months. Up until a couple weeks ago it was apparently improperly installed by my po rresulting in false allegations of tampering. I believe this was intentional to increas my time wearing it. My po alsi threw out a negative etg test ttaken 1 day after tampering was reported by this sleazy company. I am in NY. When do the class actions lawsuits begin here? And shouldnt our government be hdld liable as well?

  2. Just last week I got a notice from my public defender say that I was in violation of scram conditions. But I was at home all night with my family. I haven't had a drink since my DUI last year. I continue to wonder if the ankle monitor is even real. When I some to my case manager, he told me that the device is 100 percent reliable but that cannot be because o was asleep on the date and time of the so called drinking episode. Can anyone refer me to a good attorney?

    1. The device is actually not 100% reliable. I've read studies that say it's 90-95% accurate, and I suspect even that is an over statement.

  3. I have been wearing the ankle monitor system since August 28th 2015. I have had countless issues with scram. The biggest was that I was charged for a violation of having alcohol positively read by the SCRAM ankle monitor. I just so happen to not only be sober but in a rehab living center, and immediately got a test to prove I did not have alcohol in my system. My case was then fast tracked because the judge was angry. I was sentenced to 10 days in jail and 1 year on the ankle monitor, and was not given credit for 74 days i was on the scram program in the beginning. This is just the biggest issue, let alone others. Money, time, incarceration.

  7. Another Judge Finds Scram of California, Inc., and Alcohol Monitoring Systems, Inc., unreliable:

    If urinalysis has a 99.8% chance of being accurate, that would mean 2 out of 1,000 test would produce a false positive. Sounds good right? SCRAM, with their estimated 17,000,000 tests this would mean that 34,000 false positives occurred. Fortunately this device won't just measure anything, so when a defendant is sleeping he/she is safe from false positives cutting this into an estimated third, right? Wrong, there are tests for obstructions as well, Jon Ugval of H.A.S. in Michigan claims it can detect socks!! Fact is there is no way to get an estimation on the accuracy of the equipment because the proprietors have obfuscated and have yet to acknowledge the possibilities of erroneous readings. Also, there is still an undetermined amount of ways the system can fail:

    Judge William White, an Escambia County judge recently dismissed a claim that Dennis Gossman had violated probation by drinking alcohol. The judge was not convinced the device that claimed he drank on several occasions was accurate.In his ruling, he cited concerns about the fallibility of the device and noted that Mr. Gossman voluntarily submitted blood for tests that showed he had no alcohol in his system while the device read otherwise. Although local officers at two police stations denied him a breathtest he had plenty of witnesses to back his claim of abstinence. Judge White has pointed out a possibility that until now, was not dicussed in previous posts here, ""the unique combination of environmental factors, including the defendant's playing of an electric guitar, may have had some unexpected impact," such as the radio frequency interference (RFI) has an effect on PBT's earlier discussed here.Unfortunately instead of removing SCRAM, the judge said a probation officer could ask that he get a different job because the machine can't assure he adhere's to the terms of his probation. Inventor, Jeffrey Hawthorne, said it had virtually no "false positives" despite thousands of tests. Virtually, meaning that one has not been proven because they are smart enough to pilfer the time that a toxicology test could prove otherwise, or is this is because they never tested it for false positives. I recently found an article where the probation department was debating the use of SCRAM.

  8. In this report the author, David Hunt, drinks and pours Listerine down his leg in an attempt to cover the episode, which SCRAM detected. I wrote Mr. Hunt and said," I have just read your article on SCRAM and noticed yet more tests on TAC/BAC,time delays and obstruction device.FACT: If you consume alcohol SCRAM will tell, no one ever works on outside influences to see if they can create a false positive (If you find someone to try this, use gas and it is an almost guarantee)...Try this without drinking!!!! "Pulling my sock under the SCRAM didn't stop the readings either", he said.....I wrote,"It is like a cast, itching and rashes are common, how much of the sock did you use, try it again with less and less and see for yourself, I already know!" I got a response from the gentleman that quotes,"Nothing about what I wrote was false. Maybe different "experimenting" would have led to different results. But what I did and what it told me I was doing were put in the paper just as they were. I can't find an argument to be made against the technology, but I'll admit to being skeptical when they strapped it on my ankle." His response goes on to say,"You make a good point about the "mouthwash test." I did it the way I did on purpose. The SCRAM people told me that a lot of people drink alcohol and use such an "accident" as a cover when the PO shows up. If you ask me the "SCRAM people" cleverly did this as a propaganda stunt, using the author as a pawn. There is no way to tell if the defendant used this to cover up because they do not allow a confirmatory test, although I am certain this has happened.
    At any rate, there is no way to determine the accuracy of the device because we don't even know all of the ways SCRAM can produce erroneous readings. RFI may have been the result of a previosly posted false positive where the defendant was in the hospital. My guess,there is a host of possibility's yet to be discovered but it will be interesting to see if they perjure themselves claiming," SCRAM has never read a false positive" in the case I am sitting in on December 1.


    In his ruling, made public Monday, White cited concerns about the fallibility of the device, which is strapped around the offender's ankle and measures vapors as they leave the body.White noted that Gossman voluntarily took blood tests that showed he had no alcohol in his system when the ankle device said he had been drinking.While the technology usually works, "the unique combination of environmental factors, including the defendant's playing of an electric guitar, may have had some unexpected impact," just as radio waves can interfere with breath tests, White wrote.

    I just wanted to inform everyone that yet another class action was filed late this morning pacific standard time in the United States District Court, Central District of California. Both me and my business partner filed this federal class action against Scram of California, Inc., and its subsidiary corporation Alcohol Monitoring Systems, Inc., the case is called Roseanne Hansen, et al., v. Scram of California, Inc., and the case number is Case # 17-CV-01474.

    As such, we filed this lawsuit to vindicate the rights of two innocent girls with their whole lives ahead of them and bring them justice. This class action will extend to all Scram victims from the territories of Puerto Rico to the District of Columbia.

    On Tuesday, we are filing a class action on behalf of yet two other girls who fell victim to Scram and bullshit. As such, it will be filed in the Federal District Court of Nevada. This class action will only extend to the states of California, Arizona and Nevada.

    Also we are anticipating in filing another class action in Federal Court and will extend and cover the entire State of Louisiana and Scram victims in that state. Scram and Alcohol Monitoring will be getting their asses handed to them very soon. In time, the governors of each state will be sued and contracts for these assholes will be vacated and destroyed.     Its not because of Scram, its because the people that were on Scram. None of the people want to comply with any requests that I or any of the attorneys have. I cant even have a phone call with none of the Scram people. They all want to sit here for hours and have conversations of text messages, and the remaining ones want to call at 5:00 am. And when I tell them what time it is, they get mad at me.

    So good luck to everyone. Hope all works out. I have other stuff to do is life than text people and try to get ahold of people on facebook. Its all a complete waste of time. But I will always be in the good fight.

    I wanted to send notice out to everyone to let them know that a third class action lawsuit was filed on July 28, 2017 by the Law Offices of Edwin I. Aimufua. In this federal class action lawsuit, Defendants Scram of California, Inc., and Alcohol Monitoring Systems, Inc., are violating the federal constitutional rights of people of Scram Alcohol monitoring, as well as ones that are no longer on Scram.

    In the United States District Court, Central District of California, the case Jennifer Oh, et al., v. Scram of California, Inc., 68 parties are being sued for violations of the First, Sixth, and Fourteenth Amendments to the United States Constitution.

    For those who are victims of ANY scram violation, no matter what state that you reside in, jurisdiction rests in the Federal Court of Los Angeles where the Defendants conduct their business. This case is premised on delayed reports by the Defendants. Scram, AMS and other alcohol monitoring companies are waiting two to three weeks to inform the person on Scram that they allegedly violated their Scram conditions. In some instances, Scram and AMS have waited two months to inform the person wearing Scram. Thereby it denies the person on Scram to go get a blood test within the window of opportunity of 24 hours to show the person has not consumed any alcohol.

    Now Scram of California, Inc., must pay the piper for this one, and pay millions of dollars in this class action based entirely on the fact that their is no prerequisites to a federal lawsuit, and no ordinance applies to the federal constitution. Nothing.

    This case is open and shut, and now we shall see who comes out on top as the winner. Thank you to Anthony Oliver for putting this all together.

  23. I just started on Scram Bracelet on Sept. 27, 2017; voluntary pre-trial.
    I just was told today, I had a Tampering Violation from my Monitoring Company from Oct. 10th---I wasn't able to test daily at first until I could get my Internet connected & my Base Unit to work-- so, went into the office a few days later. They are checking into it and will let me know in 24-48 hours -- I WASN'T DRINKING or Tampering. So, these previous comments explain why the Owner of the Monitoring Company was so Defensive when I talked on the Phone with him tonite.
    Just wondering what is in store for me in the next few months?

Scram has managed to reach the southern hemistphere and has convinced drug court witch has only been in my country New Zealand for 3 years that there the best and newst technology around . Im very lucky to be in drug court and have nothing but graditude and up most respect to the judges and drug court staff for the hard work and opportunitys an help thay provide to help me overcome my addictions .Im an alcoholic addict and have 150 days clean time .I have had to go through 5 tampers in 2months My first tamper took them 3 weeks to report . Thay have a sub station all the way over in the states we upload here in new zealand and send it to be analysed there . Anyway i went to court today and have been told i have to apply for an exit hearing in two weeks .thay were gonna hold me in custody but i have custody of my two daughters so let me go on bail . The judge knows me well hence way i didnt go to jail on my 2nd 3rd 4th tamper she has truly sensed that somthings not right god bless her for that . Saddly i lost my 10yr old daughter to suicide this year on jan 27th . My daughters are in my care now there mum is still using meth . Im strong in my recovery and people know me to honest and have graduated all the programs and requirements . I have so mutch to lose my girls need me now more than ever and im looking at a 2yr sentance . The judge has ordered that a scram representative fly in from the states and im basically going up against scram .     My sister in Butler County, OH is currently incarcerated for the second false pv in 6 months. She is facing 30 months in prison this time. She is innocent. She is now so broken and hopeless that I don’t think she can survive 30 months physically or mentally. This is so wrong on so many levels. Please advise for Ohio residents.

  30. I got a false positive I told them I worked around roundup that day I do landscaping I have witnesses that I didn't drink . I worked so hard to get my children a year and half of programs and doing everything perfectly 2 weeks until last court and it's all over well not now because false positive this could have me loose my children. I am beyond livid but have no idea what to do I have witnesses and receipts even photos .. it is redicoulouse it was for 10min after I got off work I said I can't drink at work I work around machines oh it shows 10 min after u got off work so they are saying I walked to my car while drinking and I magically sweated it out all within 10 minutes while walking from work to my car it doesn't even make sense it can't pass through my body that quick. What makes more sense the round up that was being used around me between 130 -2pm showed up in my sweat at 240 I get off work 230 but no they say I drank during that time and sweated it out exact same time..i am so upset and have no idea what to do.. They will probably force me to say I did it to be able to see kids like the forced me when I was fighting the charge that got me to this point. Orange county is most scandalous county in ca and that is a fact. Thank u for letting me vent

  34. advice to anyone wearing the scram, if you have insurance and are worried about a false positive. Have your doctor give you a script for the ETG urine test. This test "allegedly" goes back 80 hours in detecting alcohol. I recommend have one twice per week. This way, you can prove you have not been drinking in the case of a false positive.

  36. I have been on the Scram Monitor for 130 days now and apparently I have 3 tampered test results !!! I also test for averhealth a random drug and alcohol testing program, and also am enrolled in an out patient drug and alcohol program which I also test for drugs and alcohol and the days in question about the tampering allegations I tested clean for both alcohol and drugs at both programs . Now I am just waiting for the ramifications of these alleged allegations.
