United States District Judge Dennis Powers finds Scram of California and Alcohol Monitoring Systems Unreliable

Judge Dennis Powers of the Novi District Court in Michigan found that an alcohol monitoring device frequently used in drunk driving cases to compel sobriety lacked scientific reliability, according to Patrick Barone of Birmingham Michigan, the defense attorney who successfully argued the case. The new device being examined by the Court, commonly referred to as a SCRAM Device, is an ankle bracelet worn by drunk drivers who are on bond to continuously monitor alcohol use. It has been recently used in 23 states for drunk driving cases. According to Barone, the unreliable device has caused many people to be mistakenly taken back into custody based upon flawed readings.The ruling, which is considered the country to thoroughly examine the reliability of the device, came after two days of testimony from Jeffrey Hawthorn, the patent holder, and Dr. Michael Hlastala a nationally known physiologist from the University of Washington. The SCRAM device's reliability was called into question after the Oakland County Prosecutor's Office sought to revoke the bond of defendant Lisa Glaza, who has been charged with drunk driving causing death, and as part of her bond conditions was ordered to wear an ankle bracelet manufactured by Alcohol Monitoring Systems called a Secure Continuous Remote Alcohol Monitor, or SCRAM bracelet. The prosecution claimed that Ms. Glaza had consumed alcohol over a two day period while on bond, based solely on the SCRAM results. Because Ms. Glaza denied drinking, Southfield attorney Mark Satawa had Ms. Glaza take a polygraph examination, which she passed. Mr. Jeffery Hawthorn asserted that his company's SCRAM bracelet has never had a false positive. Mr. Hawthorn explained that the bracelet measures the amount of alcohol in the wearer's body by measuring perspiration. The science of measuring alcohol in this way has been around since the 1930's, but his product has been on the market for only about one year. Mr. Hawthorn claimed that the readings from Ms. Glaza's bracelet clearly showed not only a pattern associated with a drinking episode, but also that she had attempted to block or tamper with the device during this same time period. Dr. Michael Hlastala told the Judge that the readings from the device looked more like instrument drift than drinking. "The numbers just don't add up", stated Hlastala. "It is biologically impossible for the metabolism of alcohol to have produced the readings Ms. Glaza's bracelet did in this case". Dr. Hlastala also offered other causes for the SCRAM readings, such as food converting to alcohol inside the body, and that the SCRAM device uses alcohol measuring technology that has been shown to be non-specific for beverage alcohol. "Consequently, certain kinds of cosmetics and other things can trigger a positive reading. Looking just at the numbers it's impossible to know if they are from drinking or if the numbers mean something else", stated Hlastala. Mr. Barone stated that this SCRAM bracelet has probably never been subjected to this kind of scrutiny in Court. "Unfortunately, there are at least several hundred people in Michigan alone that a face loss of liberty after being falsely accused of drinking while on bond", states Mr. Barone. "Until the SCRAM bracelet has been properly studied by the scientific community it simply shouldn't be used. The Courts have really jumped the gun on this." Mr. Barone believes that Judge Power's ruling will cause government agencies throughout the country to re-think their use of the SCRAM bracelet, until its reliability can be accepted in the scientific community.

    The set back is that if the person on Scram doesn't pay the high end prices, the person is generally threatened by the Scram bums with jail time unless the person on Scram pays the high prices.

I had a scam device on my ankle for a DUI probation violation it was put on in February 10th 2016 I was called from my probation officer in Mid April he told me he received an Email from the tether company showing a tamper he said I tampered with it from 2:36am till 3:34 pm I was at work until 4:00 am got home at 5:30ish am took a shower and went right to bed woke up around Noonish and woke up the tether and downloaded it.anyways I ended up getting put in jail for the DUI while in jail I was arrested on October 4thfor tampering with an electronic monitoring device.I didn't do anything to tamper with this thing at all.so what they are calling a tamper is my body temperature went up 10 degrees I also had a hole rubbed in my leg because of it being so tight and I wear work boots because my job the hole it made in my leg got infected real bad and was smelling terrible no alcohol has ever been detected at all. My question is would the sore it caused and the infection make my temperature rise on the hole it made someone told me that the infected area would be a higher temperature as my whole temperature is this true.still going to court over this I'm not willing to accept a plea bargain I am innocent on this.

  4. FIRST FEDERAL SCRAM CLASS ACTION LAWSUIT FILED




    I just wanted to inform everyone that yet another class action was filed late this morning pacific standard time in the United States District Court, Central District of California. Both me and my business partner filed this federal class action against Scram of California, Inc., and its subsidiary corporation Alcohol Monitoring Systems, Inc., the case is called Roseanne Hansen, et al., v. Scram of California, Inc., and the case number is Case # 17-CV-01474.

    As such, we filed this lawsuit to vindicate the rights of two innocent girls with their whole lives ahead of them and bring them justice. This class action will extend to all Scram victims from the territories of Puerto Rico to the District of Columbia.

    On Tuesday, we are filing a class action on behalf of yet two other girls who fell victim to Scram and bullshit. As such, it will be filed in the Federal District Court of Nevada. This class action will only extend to the states of California, Arizona and Nevada.

    Also we are anticipating in filing another class action in Federal Court and will extend and cover the entire State of Louisiana and Scram victims in that state. Scram and Alcohol Monitoring will be getting their asses handed to them very soon. In time, the governors of each state will be sued and contracts for these assholes will be vacated and destroyed.       I would love to help your ongoing cases regarding the SCRAM device. I was fitted with a device here in Roseville, CA (Placer County) before I was even convicted of a crime. I was afforded no due process before being BRANDED with a device that interfered with my career. I travel for work, and am out of town for weeks on end.

      Because of my travel schedule and no home base to plug in the charging unit I was required to check in with the probation department weekly to download the data. I lost my career because I could not perform my duties with this egregious requirement. To boot, I sat through an entire day of court watching any and every alcohol related case end up with a SCRAM fitting.

      This is profiteering and raqueteering at it's finest all done under the guise of protecting public safety. Please contact me.

  7. I am a victim and a plaintiff in the 3rd class action lawsuit against AMS scram. I want to thank Anthony Oliver for all of his hard work and making this happen. I went through hell literally for 7 months with this device on my ankle. It is virtually impossible to avoid getting some sort of violation whether it be tampering or picking up chemicals that can be similar to alcohol on your body. You don't have to consume alcohol to get a violation on this device I can guarantee you that. It happened to me twice. There are so many environmental factors that can cause a false positive. One drop of gasoline on your leg near the device can easily cause a false positive. Even shampoos some soaps. Try to find hygiene products that don't contain some sort of alcohol. It's almost impossible. I'm also diabetic and on many different medications. Ketoacidosis can occur in diabetics and it's due to consistently high sugar levels that can build up acetone in your blood if I'm sweating that out the device is going to pick that up as alcohol and one of my violations I believe that is exactly what happened. Supposedly it read alcohol from 11 PM to 11 AM. I was in bed asleep that entire time. The manager from the Denton, Tx Branch comes into the courtroom testifying and guaranteeing that I consumed alcohol when I did not touch any. This resulted in more conditions being added on to my bond it's lengthened my entire Bond and probation process. My case should be done and over with by now and I should be totally free but due to AMS scram I'm still dealing with this case and I've got a judge now who does not trust me or believe me. Now I'm sweating it out with my breathalyzer. I've had some false positives on that as well due to consumption of couple of products that I didn't know contained a very small amount of alcohol. Scram had to replace my bracelet also I believe three times because of defects and not working properly and they were demanding that I get to their office as soon as possible they were calling me on the phone hassling me asking me how late I was staying up and what time I go to bed so they could piece together some way to say I was drinking when I wasn't. Both of my scram violations happened late at night when I was in bed. Then they claimed that I tampered with the unit and actually what it happened is my sock accidentally got tucked up underneath it and so it couldn't get any readings from my body. This company is a joke and so is their product. They claim that their product is perfect when it is far from. After the bracelet was removed and I found out the lawsuit was being filed I went and did a hair follicle test that is specialized and finding just alcohol consumed over a certain period of time. They went back six months on the hair follicle test by using my underarm hair. The test results were completely negative which is correct because I didn't consume alcohol and scram claims I consumed alcohol twice. We need as many people as possible to join us in this third class action suit.

  9. After 63 days of wearing SCRAM on my right ankle I had them move it my left. That is when I discovered the scare it had left behind and I have lost feeling in that patch of skin. I'm a runner and now I have a strange pain around that area of skin, feels like my skin is on fire. Now that this barbaric device is now on my other leg I will soon be having a matching scars. I am so emotionally messed up because I was not prepared to be branded by the court without my consent. 858 882-7951 Emmy

  11. I've read this blog and I'm sure everyone is aware that Anthony Oliver has been sentenced 20 years in Prison. Although these were charges not related to his involvement with this matter, I've learned that several persons sent him money to assist them. Once he received the funds, he wasn't heard from again. Or, he had persons send money to appear at hearing, and was a no show. His actions are digusting!

    Know that I've just become aware of the implications of the SCRAM Monitoring Systems, false reports, alledged tampering etc etc. And, although I'm certain there are many who fear getting involved due to their previous experiences with Anthony, I truly want to hear from as many of you as possible. I will NEVER ask for money and PLEASE DO NOT SEND ANY FUNDS TO ANYONE believing they can help you. I realize this is affecting so many people and it's emotional for everyone. This takes time, and I have just started researching this. I did speak to an Attorney this afternoon and he is interested in the possibility of filing a Class Action Suit.
